This Case Epilogue written February 1, 2017 is intended to provide context to this web site as it documents a Canadian constitutional challenge spanning from 2004 to 2016. Bruce Montague determined to expose the constitutional violations in the Canadian Firearms Act. After being charged, mounting a constitutional challenge and appealing to the Supreme Court of Canada, Montague's case was dismissed without reasons. With Bruce in jail, the Montagues then faced an another twist of injustice -- the confiscation of their home and property by the Ontario government. The Montagues fought the civil forfeiture of their home for years until, in the summer of 2016, the Canadian Constitution Foundation was instrumental in negotiating with the Ontario Civil Forfeiture department to drop the lien against the Montague home. The Canadian Constitution Foundation deserves our support as they continue to fight other cases of injustice around the country. YOU COULD BE NEXT! Apr25: Court Report and Road Tour Success

Dear Supporters:

Donna and I had our court appearance today in Dryden. It was so nice to see such a crowded court room full of supporters (standing room only). A special thank you to all who took the time to show up in support. It really makes a difference for both Donna and I to see the moral support, and also for the courts to see that this is an important issue.

As usual the Crown was not prepared. Not only that, but they also failed to provide us with the full disclosure that the judge had ordered the crown to provide by the end of March. Despite not having full disclosure the judge has ordered that a judicial pre-trial be conducted on June 20th at 1:00pm in Dryden.

I'm not sure how this is supposed to work when we still don't have full disclosure. I asked the judge for some clarification in this area but did not receive a clear answer. The judge alluded that the crown's failure to deliver the disclosure on time may work to our advantage. Possibly the partial disclosure we have now will be considered complete. It will be interesting to see the pre-trial hearing, when we have all the lawyers and the judge in the same room together.

The road tour started on Jan 28th and just finished with my last talk on April 19th in St. Catharines. That's nearly three months on the road minus a 10 day rest I took at home in the beginning of March between the western and eastern part of the tour. The tour was very exhausting, but well worth it! I got to meet with many good Canadians, all bound by our common goal of fighting for our constitutionally guaranteed rights and freedoms. We are definitely spreading the word across Canada about this exciting opportunity we have to strike down the ill-conceived Firearms Act in the courts.

We are also seeing a steady increase in the trust fund that was set up to pay the expenses of this charter challenge. I don't have an exact figure yet, but generous donors have contributed in excess of $60,000 so far. THANK YOU! (That's 1/5 of our $300,000 goal) We are currently looking at putting more complete financial information on the web site so that everyone can see how the fund raising is going at a glance. (Currently totals are disclosed only in these news letters.)

It's great to see the support and commitment of so many volunteers that have helped out in this cross-country tour. It may surprise you to learn that I didn't spend a single night in a motel during this trip. It felt a little strange at first to accept the hospitality of strangers who were willing to take me into their home, feed me and give me a bed to sleep in. Of course they weren't really strangers; we have a common bond and goal in striking down this obnoxious law, and we were in contact via phone and/or e-mail.

I was encouraged to work with very active supporters of our rights and freedoms (i.e. the Constitution). Besides raising funds and awareness towards this court battle, we also gained a lot of help in other ways. Some supporters have donated goods and services while others have come forward to offer their skills, whether it be media, legal, marketing, or technical. There are many more ways supporters have helped out and we greatly appreciate everyone's contribution towards this charter challenge.

We still have a long way to go, so let's keep pressing on toward the supreme court. Thank you all, and God bless.
